The Formula
Maternity benefit is calculated based on the average daily wage and the leave duration applicable to your situation:
Average Daily Wage = Monthly salary ÷ 30
Leave Duration:
• 1st or 2nd child: 26 weeks (182 days)
• 3rd child onwards: 12 weeks (84 days)
• Adoption (child under 3 months): 12 weeks (84 days)
• Surrogacy (commissioning mother): 12 weeks (84 days)
• Miscarriage / MTP: 6 weeks (42 days)
• Tubectomy: 2 weeks (14 days)
Who Pays:
• ESI-covered (salary ≤ ₹21,000): ESIC pays 100% of average daily wage
• Non-ESI (salary > ₹21,000): Employer pays full salary
Eligibility requires 80 days of work in the 12 months immediately preceding the expected date of delivery.

Priya works at a private IT company in Bangalore with a monthly salary of ₹60,000. She is expecting her first child and wants to know her maternity leave and pay entitlement.
