The Formula

Maternity benefit is calculated based on the average daily wage and the leave duration applicable to your situation:

Maternity Benefit = Average Daily Wage × Leave Days

Average Daily Wage = Monthly salary ÷ 30

Leave Duration:
• 1st or 2nd child: 26 weeks (182 days)
• 3rd child onwards: 12 weeks (84 days)
• Adoption (child under 3 months): 12 weeks (84 days)
• Surrogacy (commissioning mother): 12 weeks (84 days)
• Miscarriage / MTP: 6 weeks (42 days)
• Tubectomy: 2 weeks (14 days)

Who Pays:
• ESI-covered (salary ≤ ₹21,000): ESIC pays 100% of average daily wage
• Non-ESI (salary > ₹21,000): Employer pays full salary

Eligibility requires 80 days of work in the 12 months immediately preceding the expected date of delivery.

Priya is entitled to 26 weeks of maternity leave with total pay of ₹3,64,000, paid by her employer. She can take up to 8 weeks before her expected delivery date and the remaining 18 weeks after.

FAQ

Under the Maternity Benefit (Amendment) Act, 2017, women are entitled to 26 weeks (182 days) of paid maternity leave for the first two children. For the third child onwards, the entitlement is 12 weeks (84 days). Of the 26 weeks, a maximum of 8 weeks can be taken before the expected delivery date. The remaining weeks are for after delivery. This applies to all establishments covered under the Maternity Benefit Act 1961.
It depends on whether you are covered under ESI (Employees’ State Insurance). If your monthly salary is ₹21,000 or below and your establishment is ESI-covered, ESIC pays 100% of your average daily wage from the ESI fund. If your salary is above ₹21,000, you fall under the Maternity Benefit Act and your employer pays the full salary directly. Either way, you receive the same benefit amount — the difference is only in the funding source.
Under the 2017 amendment, an adopting mother is entitled to 12 weeks of maternity leave if the adopted child is under 3 months of age, from the date the child is handed over. A commissioning mother (in surrogacy) also gets 12 weeks from the date of handover. For adoption of a child aged 3 months or older, there is no statutory maternity leave entitlement, though individual employers may have their own policies.
Under Section 9A of the Maternity Benefit Act, a woman who has a miscarriage or medical termination of pregnancy (MTP) is entitled to 6 weeks of paid leave from the day immediately following the event. For a tubectomy operation, the entitlement is 2 weeks of paid leave from the day of the operation. Both are paid at the rate of average daily wage.
To be eligible for maternity benefit under the Maternity Benefit Act, a woman must have worked for at least 80 days in the 12 months immediately preceding the expected date of delivery. For ESI maternity benefit, the employee must have contributed to ESI for at least 70 days in the 2 preceding contribution periods. The Act applies to all establishments employing 10 or more persons (factories, mines, plantations, shops, and other establishments notified by state governments).
